Membership Agreement
In order to meet the criteria for participation with the Freestore Foodbank,
agencies must agree to:
- Have a 501(c)(3) tax-exempt status with the IRS (not a 501(c)(3) private foundation)
or be an qualifying non-profit church, and have an established food distribution
program.
- Directly serve the needy, as defined by the IRS code 170(e)(3). (See Attachment.)
- Distribute Foodbank product directly to the program?s clients (recipients).
Foodbank product may not be distributed to another agency, group or organization
for redistribution.
- Not sell or use Foodbank product in exchange for money, property or other
services.
- Distribute Foodbank product free of charge to recipients, with no suggested
or implied donation amount or volunteer requirement. Any recipient donations
must be anonymous and voluntary.
- Not exclude recipients on the grounds of race, religion, national origin,
gender, politics, veteran?s status, disability, medical condition, age
or sexual orientation.
- Not require recipients to be a member of any organization or participate
in any religious service as a condition for distribution or receipt of emergency
food.
- Load, unload and transport product from the Foodbank warehouse or drop
site.
- Have adequate storage space and refrigeration to ensure the integrity and
safety of Foodbank product until it is used or distributed. Product may
not be hoarded. Hoarding consists of storing product for more than 120 days
past receipt.
- Abide by established standards of America?s Second Harvest and any other
applicable local, state, and federal laws regarding food handling, safety,
and storage.
- Have at least one key staff person or volunteer trained in safe food handling
if the agency prepares and serves meals on-site.
- Abide by any additional product restrictions (as defined by the donor.)
- Keep sufficient records to track the distribution of Foodbank product,
including distribution records and Foodbank receipts for at least three years.
The program shall maintain adequate books and records, and make them available
upon request.
- Provide the Foodbank with requested statistical information and program
support. Service statistics, client demographics, and research data collection
will support the Foodbank and the member agency network?s advocacy, public
policy and development needs.
- Contribute shared maintenance fees to support Foodbank operational expenses.
Shared maintenance fees shall be received by the Foodbank no later than
thirty days from the statement date, and drawn on the agencies? 501(c)(3)
checking account.
- Allow site visits to monitor the operation, sometimes without prior notification,
and report any changes in address, contact information or personnel to
the Agency Services Department.
- Use the Foodbank account on a regular basis. Accounts unused for 18 months,
or suspended for 6 months, may be closed. Violations of the Membership
Agreement may result in warnings, suspension and/or termination. Agencies
have the right to appeal and/or reapply.
